I know that some people have been asking for a more civil tone, and I suppose that I should set an example. I've met some very intelligent and interesting people through this board, so I will take their advice and try to lighten up a bit.

However, I have been pretty caught up in emotions because it looks like my worst fears are becoming reality.

As of this writing, I can confirm the following FACTS:

1) BMG has still not been paid.
2) G Whiz has still not been paid.
3) If BMG is not paid in full, the discs intended for AU will go to Amazon and the other retailers before AU. You will have to wait until AU pays for the discs.

I am not posting here to spread panic, or to treat Ross badly, or anything of the sort. However, I am making the following recommendation:

Set a deadline of Wednesday, October 16.

If BMG has not been paid IN FULL, and if G Whiz has not been paid IN FULL by 10/16, please cancel your order and buy from a reputable site, such as Amazon. If you are fairly confident that this warning is correct, you can cancel now by calling 888-5-COMICS, or visiting http://www.drygrass.com/mscl.

Finally, I would just like to say that although AU might have asked certain people to not speak with me, I know a lot of people at a lot of companies and I will continue to provide accurate news.

As of today CMI has no money. CMI will most likey not be able to make it happen.

1) Where is the money?
2) who controls this company?
3) stock holder revolt?
4) let's storm the castle.

I was willing to stick with AU. (Yeah, I know. I'm a glutton for punishment.) But now I think I'll take Jason's advice. I will give them until Oct. 16th to pay their vendors or I cancel my order.

For what it's worth, I really do hope AU comes through and pays BMG, etc. I was ok with paying the extra money to get the bonus disc and lunchbox. I'm extremely disappointed that after 9 months of putting up with AU's bullsh**, I have to give up the "extras" and get my DVDs from Amazon. :(

Jason - I really appreciate everything you've done for us. Without you this project would have wilted and died long ago. Please continue to keep us informed when you get any new info.

What could possibly change between now and the 16th? AU obviously doesn't have the money to pay BMG and they probably won't get it anytime soon. I can't image Ross would be playing games at this late date, so AU must have run out of cash. I think it's time to submit an entry to fuckedcompany.com

Jason, could you provide aggregate statistical data on the doublecharges from the website Gord set up. I'd be very interested in knowing when the double charges started and stopped, and the standard mean/deviation of the time between the initial payment and the doublecharge. Given the severe cash crunch AU is obviously in, it now seems possible that the doublecharges were deliberate.

Probably nothing will change. If AU hasn't paid BMG by now, I doubt they ever will. But I want to give them one last chance to prove themselves. However I also refuse to allow AU to screw me over. (Anymore than they already have, I mean.) Ross if you read this take note: you have until October 16.

I think it is important for everyone to seek dispute through their credit card company, should you decide to cancel your order. And of course seek a refund through AU, But....

I realize that many of you have ordered your set more than 60 days ago. I was fortunate enough to wait until a month ago, hence I easily canceled through my credit card company. For those of you who purchased the set before that, you will in all likliehood be told by your CC company INITIALLY that the charge is too old. However, if you persevere and speak to a manager and explain the circumstances, that in fact the breach, or failure to provide the set occurred on 9/17/02, you should be ok.

I myself am an attorney and spoke to my CC company today (a large one) and was told about what I expected. Do NOT be deterred by the initial response.

If the rumours are true and there is a cash crisis at AU, and the discs are in jeapordy, I would not hesitate to contact the local Attorney General. All large jurisdictions now have an internet fraud unit.

I would not recommend waiting and later filing a small claim suit. If it comes to that my guess is that you will end up with a judgement. That and 50 cents will get you a Coke.

I hesitate to mention this, because it contradicts an earlier post of mine, but if in fact there is proof of deliberate overcharges, it brings back the aspect of a class action suit, though I still don't see that.

I've been involved in civil and criminal litigation for a long time. Something smells here, if what I am reading is true. IMO. (lol legal caveat).

I was looking up CMIH on google and found a sit that gives us a bit more information. I know nothing about stocks, does anyone know if anything on this page speaks of CMIHs current financial status? Specifically, does anyone know what estimated market cap means?

Here's something to add fuel to the fire. I found this while looking for my order number.

From a mass emailing by AU on March 26, 2002:
First, I'll tell of the progress:
1) AU signed an agreement to begin manufacturing of pre-order
packaging by G-Whiz Online. Shipment of pre-order packaging due
in late May
2) There will be a press release from BMG, I am told, very shortly.
3) Full payment for the sets is going out to BMG next week.
4) There is a delivery date of late May/early June for the DVDs
from BMG.
5) Permitting one week for assembly, AnotherUniverse.com are
tentatively scheduling the release for 6/18/02. If there are changes
due to scheduling bonus material, I will let you know immediately.

With regard to trying to cancel orders...

I ordered by credit card so it seems like there is hope for recovering my money if I decide to cancel. If anotheruniverse is having money troubles, we have no reason to believe refunds will actually be given without intervention by our credit card companies.

What about people that ordered using debit cards? Do banks offer the same protections as credit cards?

And just a comment to Jason, if your recommendation is to cancel come October 16th, have you thought about trying to reach those customers that don't access this message board? Or do you think that most people are checking out this forum?

So Ross has been lying to us since the beginning?! :x
The tiny amount of trust I had in AU/Ross is gone. Perhaps I should cancel sooner than October 16th, before they run out of money.

CMI's total stock is worth a lot less that they charged customers credit cards. CMI does not have the funds to repay at this time and the DVDs and lunchboxes are not even close to being shipped to AU. This is all verified. If you check out the penny stock boards you will find thousands of angery stock holders.

At this point everyone needs to help out AU or storm the castle and shut it down. If you wait to ask your credit card company for a refund, you will have a problem. There are not to many options at this point.

Any one in this forum a stock holder?
