Here was my conversation with Wade on Tuesday, Oct. 22nd, and it's pretty darn close to exactly what was said:

Me: I'd like to cancel an order I placed with you a while ago.
Wade: Okay. What's your order number and name?
Me: #W3214146, Kristin S-----
Wade: Alright Kristin... you odered the MSCL DVDs. You know that BMG is shipping them to us next week and we'll be mailing them out right away?
Me: Yes, I've read that, but I'm a college student and just can't afford it anymore.
Wade: Okay, I understand completely. Oh, and unfortunately you are a victim of the double charges, but there's a note here that you already told your bank. I'm entering your cancellation into the computer right now, and it will be sent to the accounting department to make sure you recieve any refunds due to you.
Me: I recieved two provisional credits from my bank the day I reported it to them.
Wade: Yes, but your cancelled order will still go to the accounting department just to make sure.
Me: Okay, so my order is cancelled now?
Wade: Yes.
Me: Thanks.

Wade was actually quite nice and didn't "rush" me off the phone, like people here have said has happened to them when dealing with Wade. I forgot, however, to ask for an email confirmation, but I did fill out the drygrass form. I felt pretty secure after that call, but should I? I don't know what else I'm able to do.

Well, I am still eargerly waiting to read the story over at the digital bits.

Also, I faxed my other credit card company all the dispute information,
including e-mails to me, from Ross, stating he would take care of my
refund, "next week." (That was two weeks ago.)

Here's the latest e-mail I sent off to AU:

Ross and others at AU-

I got the e-mail today suggesting I might want to
reconsider and not cancel my orders with AU
for the My So-Called Life DVD Box set.

Well, I cannot imagine what fools would agree
to this, when you have not refunded our money
after promises made to do so, in my case 13 days ago.

Still no sign of any credit on my cards, and no
vendor has EVER taken this long to refund me my money.

Both credit cards companies associated with
my two orders are now working on
dispute claims, and possible fraud charges.

ALL OF THIS CAN BE STOPPED IF YOU CREDIT MY
CREDIT CARDS IMMEDIATELY.

Order #W3208501
One box set of My So-Called Life
Charged 2/12/2002 $20.00
Charged 3/12/2002 $79.98
Charged 7/23/2002 $115.00 (double charge)

Order #W3209621
One box set of My So-Called Life
Credit Card Charged 2/12/2002 $20.00
Credit Card Charged 3/12/2002 $79.98

Both orders have been cancelled and there is
no sign of progress on getting my money back,
and to think you would "hold off" on dealing with
refunds in case we changed our minds!?!?!

Since you are processing the people who un-cancel
their orders and hope to ship the DVDs by 11/1/2002,
it is more than reasonable to think you will have
had more than adequate time to deal with the refunds
and send those out as well.

If I do not see the total $314.96 credited back
to my credit cards by November 1, 2002,
I will be filling a complaint here:
http://www.ifccfbi.gov

Please attend to this matter immediately,

(My name, address, and contact information were
included here.)

Like I said, if they can process and ship out the DVDs on
11/1/2002, they can certainly process and send out all of the
refunds by that same date.

Refund

Post by kartar » Oct 25th 2002, 8:37 pm

I am in the same boat. I just emailed Ross directly because I cancelled 14 days ago and have received no credit. My follow ups on the topic have received no reply. My credit card company have started dispute proceedings and I've reported the vendor to all the people I can think of.

*sigh*

Here is my reply to their plea for me to uncancel:

I am not going to uncancel my order. You have not fulfilled ANY of your obligations that were set forth when I ordered. You have also failed to stick with ANY of your own 100% Guarantee set forth on your own website.

Secure shopping- Well, I was double charged. That is NOT secure.
No Hassle Returns- I STILL have not gotten my refund for my canceled order, even though it has been 3 weeks.
Updates- Your newest email is the FIRST I have gotten since March.

If you had kept my up to date on where the project was, I would not have canceled. If ANY of your promises came to pass, I would not have canceled my order. But instead you pointed me to mscl.com and said to get my updates from that site, which is exactly what I did. You also gave me over 5 email addresses to respond to if I had a problem with my order, which I did, and then you complained that you were getting emails to various accounts.

How incompetent are you?

In any case, I have reported your theft to my credit card, and they will be in touch with you. I have also reported you to multiple fraud websites, and they will be in touch with you as well. Along with all of this, I written down my experiences with your site, and sent them to as many comic and specialty websites as I can, to make sure that the word gets out that you are not a trusted website to deal with. My congressperson has also been contacted, and they are looking into your fraud.

You are legally responsible to refund people within 30 days. You are
breaking the law, and will be held accountable.

I hope you get what you deserve,
Andrew Davis

ps. I still expect to recieve the "gift" that Ross Rojek promised to everyone who had been double charged. You don't want to make Ross Rojek any more of a lier than he already is, do you?

I might be preachin' to the choir...

Yo. Have I mentioned how much I am starting to hate AU lately? :x

I know lots of folks are sticking with AU - the most awful reason, in my book, being that they think they'll never be refunded if they cancel - and are still awaiting the disks and extras. But I gotta wonder, given the colossal f*ck up that has been Another Universe so far, how much ya wanna bet the DVDs - if they ever come - are either messed up, shipped poorly, WRONG, broken, scratched, sent to wrong address, etc. etc. etc.?? And how likely are they to correct any of said problems in our lifetime? For a while I just thught, 'Well, how bad can it get, really?' I don't think that any more. Holding out because you might not get refunded is unexceptable bullshit. How dare they hold us hostage on top of everything else.

Someone on another post said "Well, they SHOULD tend to the people who haven't cancelled first. You cancelled by choice." Some choice. Just because I CHOSE to get my money back for something I'm not likely to ever get but paid for 8 MONTHS AGO??? I can understand people that've been overcharged/doublecharged wanting immediate attention - I WAS DOUBLECHARGED TOO! But, FIRST ONES TO PAY, FIRST ONES TO BE SERVED. PERIOD. Am I wrong?

REFUND US ALREADY!!!!!! :x :x :x

Sorry for the rant. Wait. NO I'M NOT!!   [/i]

Of course defective items will NOT be exchanged; this would cost AU money. But you must understand, AU will NOT refund our money under any circumstances. So those who haven't cancelled really have nothing else to lose since their money is already gone.

Why not. Ross has figured out that he WILL get away with it. Why bother refunding the money if nobody can/will force him to? If Authorize.net gave a damn about this, they would have cancelled AU's merchant account by now.

On the bright side, it's nice to know that if I ever start a business, I can get away with $50,000 of fradulent charges without a scratch.

Hey there Phelix - This is a dismal state of affairs from just about every angle. But it'd cool to actually get a working set of DVDs with some sort of recourse - I daresay Amaon.com, even with its own faults, is a better bet than AU. So, by cancelling and ordering ELSEWHERE, if you're able, you at least stand a better chance of finally getting the dvds we've all paid for so long ago. Even if, as you say, we will NEVER get refunded regardless, (oh so very possible, GODDAMMIT!) at least I won't have to trust the same vendor who is currently screwing me over to deliver me a workable product.

This just sucks. But we already know that and I'd bet everyone of us has already thrown down our two cents. Yay.

Personally, I'm going to badger 'til I'm refunded.

Like many of you I'm still waiting for my money back. I've stopped feeling sorry for any of the AU employees a long time ago. After gettings thousands of calls Wade must be bright enough to put 2 and 2 together and realize that Ross has no intention of ever refunding our money. Probably because it's already been moved out of AU and CMI Holdings' control into his personal bank account.

That makes Wade, Justin, Mike and the rest of them thieves just like Ross. If they had any shread of integrity they would have quit their jobs. Yeah the economy is bad and jobs are hard to come by but I certainly wouldn't work for a crooked boss, especially one that's cheated a bunch of customers out of thousands of dollars. What's to prevent him from cheating his employees out of their paychecks?

To those of you still waiting, if you paid by credit card, dispute the charges. If the CSR tells you you cannot go up the ladder to their supervisor. If the supervisor doesn't budge ask to speak to that person's supervisor. Barring that ask to be transferred to an account retention specialist and tell them you intend to cancel your account if they can't work with you. After all, if your credit card company isn't going to protect you from a dishonest merchant why give them your business? There's plenty of other companies out there.

Oh yeah I just ordered from Amazon via share the love and super saver shipping. $60 for the set and I KNOW I won't be billed until the set is in the mail.
