cancellation backlog vs shipping
cancellation backlog vs shippingI've got a question.
BMG are alledgedly going to ship 5000 boxsets to AU on monday. AU will rush these out to customers, press-ganging workers families to help out. AU have a massive backlog of cancellations, both from drygrass, and emails to customerservice or to ross. How's that gonna work? Let's assume, say, there are 200 outstanding cancellation requests in "the queue" (or however AU handle this) If the boxsets start flying out the door to people who have already cancelled (or at least tried their hardest to), what happens then? what's the legal situation in this scenario? who's responsible for paying to ship the goods back? are we even required to return the goods, or are they now an unsolicited package? andy
If you have successfully canceled with your credit card company, and the sets are shipped anyway, then you will be able to dictate the terms of the return. ie, you can come pick them up at my house, whenever you wish, or send me a payment for costs and time to return them.
I really can not stress enough, as I've posted a few times here before, the necessity of disputing this with your credit card company or bank. It may not be easy (it was for me, one phone call) but ultimately that is everyone's best remedy. I'm a little surprised that more people are not angrier over what happened the past week. AU scrambled to make payment at the last minute. But they were paid (and paid and paid) for the sets by the customers months ago. Clearly, AU was using YOUR CREDIT CARDS as payment to float his company. Save the money, and stick it to AU at the same time. Dispute. And hope they send you the set.
I would assume that if you've sent cancellation to them, then if they send you a package, it is unsolicited. But you get into a tricky spot if you haven't disputed it with your credit card, because at this point, AU has your money, and you have the dvds, which looks completely kosher.
If you've already disputed it, and made sure to tell the bank that you canceled your order (and have an email of yours proving it, or better yet, the email Mike sent out) and then you get the item, this would be a unsolicited package. You can then either refuse it, or call your bank and tell them what happened, and see what happens. It does get tricky at that point though. The best position to be in is if you've disputed it with your bank, have proof you told AU to cancel the order, and then get the item . I'm guessing AU will wait to send everything out until after they've double checked their order status'. But who the hell knows with them.
I'm a little bitter about this entire experience but does anyone here honestly expect AU to come through with shipment? For all we know all that's left of the company is nothing further than Wade/Mike/whoever sitting in front of the computer with a headset on while Ross packs up the rest of the office and splits.
FWIW, if a package comes via First class/priority US mail you can just write in big black marker "Refused - return to sender" and the postman will take care of the rest. I'd hold on to the package though until you get your money or a way to acknowledge that you're returning the discs to AU. Otherwise I'm sure Ross will claim you received your product and he gets to keep your money.
Just to prevent further AU shenanigans, rather than mark the package "return to sender" via the USPS, I would spend the $5 to send it back UPS ground so that there is a tracking number and you can prove that you did, in fact, return the package and that someone at AU actually signed for it.
Can't you just imagine AU customer service saying, "I'm sorry but we have no record that you returned that package to us so we can't credit you the $115"?
