Digital Revival

Many new tv shows (like buffy or dawson) are available at websites and ftp-servers for download.
I know that this is legaly "grey"... But what is it with a tv show that's not on tv anymore...?
Why can't the few epsiodes of MSCL encoded as Realmedia or ASF be postet on the net?
Who may sue the posters?

If it was the company that went out of business that had the rights to them... then who would have a problem with it?
Just a thought, from someone who is in search of the lucky seven...
