BMG (the Producer) is still pressing them. They anticipate shipping us 2000 copies via ground freight tomorrow or Monday.
And this answers a couple of other question regarding the second wave, I do believe, which being: it does not yet exist.

Interesting how they didn't find this newsworthy when they send out their emails stating that they were begining to ship and would continue until all DVDs were sent out.

it looks like some of us amazon customers might see dvds at the same time or earlier than the 'second wave'. those emails were very interesting.

The threats seem to work ONLY if you're a lawyer. I lost count of how many times I have phoned, emailed, PLEADED (I tried kindness and anguish first), threatened, etc. GODDAMMIT!! It seems that only a LAWYER will get results.
Great.
You should note: I am pissed at AU. Not you. Of you, I am seriously envious.

I don't think that it was tengrand's actual occupation as a lawyer that convinced AU, but his knowledge of the law. I bet if you used the same legal threats you would see some results too. Threatening to file a claim sounds a lot better than "where the hell is my set?"
That said, give it a whirl with some legalese and see what happens!

Ricky, I understand what you mean. Its one thing I've learned, is that many corporations, with AU being a glaring example, will just basically screw people over, intimidate them and assume you will eventually give up.
As a lawyer myself, I can more readily counter these tactics, much like ten grand did. I got a quick refund from my bank, for example.
But it angers me to no end that the citizenry as a whole doesn't get the same respect. It shouldn't have to come to threats or legalese, if AU would just do the right thing. But no, they have act the way they do, knowing that most of the customers don't know what buttons to push.
One final thought - the Attorney General of each state where a transaction occurred is YOUR ATTORNEY. He is funded by your taxes. Be as adamant with the AG as you are with AU! Make the Attorney General do something.Make him help you - he works for YOU. Trust me, if the State Investigators have 100 complaints on their desk, it is the one from the consumer who keeps calling that gets addressed.
Sorta reminds me of an old cliche', eh?

That, and the fact that tengrand lives in CA, so he actually can make good on his threats. Those of us who live elsewhere are screwed.

now here's the part I do not understand: AU shipped out every box set they had and are awaiting 2000 more copies. Nevertheless they are able to send you a box set if you get nasty.
does a second wave even exist (if yes: why?) or did they just decide to take a break from shipping (if yes: will they ever continue shipping?)?
I guess some US customers and all international customers are screwed once and again...

Don't give up Ricky - obviously nagging and threatening legal action seems to scare the crap outta the few people who are left at AU (Ross notwithstanding). Keep it up until they follow through.

I DO intend to give it one more shot.
Like the rest of us, my fiance Tony and I have been awaiting this thing forever, and now we get to await a refund. Joy. I have already filed 2 complaints with VISA and with my bank. Quite frankly, I believe that those two avenues are the only way a refund will happen - in the form of a credit. I just can't see AU giving a s**t about somone's $100 bucks. I really have to wonder: if TenGrand was asking for a refund rather than a product, would his results would have been as successful?? I'm guessing no. By all accounts, AU is either broke, or is NOT parting with a dime, no matter what. I REALLY REALLY hope I'm wrong.
