Partial credit? if we don't get the bonus disc/lunchbox

are we going to get a partial charge back (refund) if they only send out the disc set without the bonus disc & lunchbox?

there are so many topics here it's hard to find any concrete evidence.

i'm wondering if i should still cancel my order. if i can get it from amazon for $60.00, the bonus disc & lunchbox (an additional $55.00) aren't worth it.

Also, Ross accepted my pulling out of the project.

AU owes me in excess of $25,000. I demand that this be credited to the customers.

I doubt that will ever happen. The sets will ship and that will probably be the last of it.

Can you really demand partial credit for 'bonus' items?

The 'bonus' items will prolly be considered 'free'. So if we don't get them, no loss on our part. Thats what the shysters at AU.com will think about it.


By the way, 5 emails to Ross, 4 with responses saying "Ill take care of it", and STILL no credit for my being Double Billed. What an ass.

Does anyone seriously believe that AU will deal with this correctly? And what about everyone who got f#cked over because of their double charge, and then canceled their order? Do we still get the promised "sorry" gift?

I think everyone's money was gambled away in Vegas a long time ago. It would be one thing if I was a middle-aged man with enough disposable income, but it seems like a lot of us that are getting rooked are young and poor. $230 is a lot of money to me and I'm sure Mastercard would greatly appreciate it. As would my STOMACH or my gas tank.

I hope the hookers and booze my interest dollars bought lulled someone into a nice, warm sleep one night. :evil:

i only want a partial refund if i don't get the bonus disk or lunchbox; it's illegal to promise someone something and then make us pay $55.00 more when they don't have any intention of delivering the goods.

if there is a class action suit against AU i'd like to join in. i don't care if it costs me money to stick it to this a$$hOle.

i bought it from them at an exaggerated cost because i was led to believe it was EXCLUSIVE (basically i had to pay it or i'd never be able to get teh dvd from anyone else).

now i find out i can get it at amazon for half the cost? what a crock! that's fraud!

If you don't go after AU for the $25,000, one of two things will happen:
  • Ross will say, "Gee, Jason's right. I will divvy up the $25K among the customers."
  • Ross will say, "Goody! Jason has publicly stated I can keep the $25K! There's one more debt I don't have to pay. Yay for me."
One doesn't necessarily need to apply something as complicated as Occam's Razor to determine which of those scenarios is the most likely to happen. Go for the money. Push for it. If it goes unpaid, report it to every authority you can. Believe me, if my amount wasn't Small Claims, I would. The amount you're owed is Grand Jury material.

I think that the drama surrounding whether the DVDS would actually be released to AU temporarily distracted us from WHY we are paying $40+ extra - namely, the lunchbox and the bonus disc.

As of today, Ross STILL hasn't worked out a payment with GWhiz (despite the fact that they have been "negotiating" a payment since Wednesday) and we haven't heard jack about the bonus disc in weeks (besides that it's being cleaned up in house by AU's webmaster).

AU's return policy states you can return merchandise within 30 days. Now here's my question - what if they start shipping the DVDs next week but 30 days later we still don't have a lunchbox or bonus disc (which is the most likely scenario since GWhiz stated that shipping from Asia will take 20-30 days AFTER production is completed)?

The AU set is not worth $99/$115 without the extra stuff, so if it turns out a few months down the road that we end up not getting the extras, will they allow us to return the set? My guess is no, which will mean that I paid twice as much for no damn reason.

I agree I would love to see Ross in court, however Jason also stated that he didn't have a signed contract, which doesn't make his claim impossible but a lot harder to prove. Plus there is another guy on here i think "Howard" who used to do some freelance wrinting for one of Ross's company's who actually has an injunction against Ross but hasn't seen any money.

I understand why jason would rather just pull out and wash his hands of the situation rather than fight any longer...25K is a lot of money, but her would end up spending more than that in legal fees and mental anguish if he pursued it.....

I still like the idea though of setting up a Personal Thank You fund for Jason, anyone who wanted to personally contribute could send some money ($5, $10, $20...or wahtever) via PayPal to Jason....someone mentioned it awhile ago, but Jason shot it down. I just hate to see him and his company walk away from this with nothing :(

that's a good point. i think i'm going to cancel my order after i get the dvds just in case there is a miracle and i get the lunchbox and bonus disc before the 30 days are up. this has been one big scam.

I'm real. :) You don't have to 'quote' my name.

I'm not sure how much it would cost to pursue $25K, but keep in mind that any fees incurred in pursuing the debt would be paid by CMI if Jason won the case. I hope Jason takes them all the way to the wall on this one.

Oral contracts are binding in the state of California, where, coincidentally, AU is!

I know, I'm not saying it can't be done, but it just makes it that much harder. I'm all for supporting Jason if he decided to pursue it, but it would be a lot for him to take on....
